McQueen, Senior Planner �(�'�� <br /> SUBJECT: Ordinance Granting Special Use for Communications Tower at I <br /> 1535 Legion Drive I <br /> The subject petition requests a special use permit to allow the construction and operation of a <br /> free standing communications tower at the rear of premises commonly known as 1535 Legion <br /> Drive. Containing a total of approximately four acres and zoned M-1 Light Industrial, the tract <br /> in question is presently developed with the American Legion Hall, a single family dwelling, and <br /> accessory buildings serving these main structures. Also, a ball diamond is located on the south <br /> one-half of the tract. The proposed tower would be located at the far southwest corner of this <br /> four acre parcel. <br /> The subject site adjoins vacant railroad right-of-way to the west with vacant property owned by <br /> the American Legion being located to the north and east. Land to the immediate south is <br /> generally vacant and is the side or rear of industrial properties having vehicular access to Route <br /> 48 South (Taylorville Road); the nearest structure is approximately 150 feet south of the subject <br /> site. Recognizing this remote location, staff is of the opinion that the proposed tower would not <br /> adversely affect or change the character of this industrial site. <br /> In view of the above data, staff recommends approval of the petition with the following <br /> stipulations: (1) that the proposed construction be in accordance with petitioner's site plan dated <br /> 3-11-97, (2) that a ten foot high chain link fence be constructed around the base of the proposed <br /> tower, and (3) that prior to construction complete building and construction plans be submitted <br /> and approved by the Department of Community Development and Department of Public Works <br /> in conjunction with issuance of a building permit. <br />
