Monies disbursed from the Special Tax Allocation Fund to reimburse <br /> Developer for Redevelopment Project Costs as set forth in Secrion 4 above shall be <br /> deemed applied in the following order: <br /> (a) First, to Interest Costs eligible for reimbursement under this <br /> Agreement, subject to the limitations contained in the Act and this Agreement; <br /> provided, however, that if in any year during the term of the Agreement the <br /> Developer is not fully reimbursed for all Interest Costs Developer has incurred <br /> which are eligible for reimbursement under the Act, Developer sha11 first be <br /> deemed to be reimbursed in any subsequent year for unreimbursed Interest Costs <br /> having accrued from previous years and shall then be deemed to be reimbursed for <br /> eligible Interest Costs for the then current year. <br /> (b) Second, to pay principal and interest obligations due on outstanding <br /> Notes, as and in the manner provided in Section 5 above. <br /> (c) Third, to reimburse Developer for other Redevelopment Project <br /> Costs Developer incurs the reimbursement of which has not then been evidenced <br /> by a Note or by interest on the loan. <br /> 8. If from time to time, the Developer has been fully reimbursed for all <br /> Redevelopment Project Costs the Developer has incurred to date, the Developer shall <br /> nonetheless be entitled to reimbursement of other Redevelopment Project Costs the <br /> Developer thereafter incurs in that yeaz or any subsequent year, subject, however, to the <br /> other provisions of this Agreement and to the Act. <br /> 9. Any Tax Increment remaining in the Special Tax Allocation Fund in any <br /> year after full reimbursement or payment of a11 Redevelopment Project Costs having then <br /> been incurred by the Developer shall, to the maximum extent permitted by the Act, be <br /> retained in the Special Tax Allocation Fund and shall be pledged to reimburse the <br /> Developer in the manner herein provided for Redevelopment Project Costs such parties <br /> may incur in subsequent years. <br /> 10. ALL REIMBURSEMENT PROVIDED FOR HEREIN SHALL BE <br /> SUBJECT TO THE FOLLOWING LIMITATIONS AS SET FORTH PREVIOUSLY: <br /> (A) WITH REGARD TO REIMBURSEMENT FOR EXPENSES RELATED TO <br /> PHASE l, AS SET OUT ON EXHIBIT 3, HERETO, AND INCLUDING INTEREST <br /> 10 <br />
