No. 96-80 Petition of CELLULAR ONE for a special use permit to allow the <br /> construction and operation of a free standing communication tower <br /> on premises commonly known as 141 Timari Court. <br /> Mr. Tim Jungles(?), Real Estate Supervisor for CellularOne, was present and spoke for the <br /> petition stating that the company is working hard to provide needed coverage for Decatur. He <br /> stated that there are communications towers similar to the one being proposed located at Martin <br /> Luther King, Jr. Drive and Eldorado Street and near Hickory Point Mall. The same type of tower <br /> was constructed near the state fairgrounds in Springfield. Mr. Jungles submitted a letter from the <br /> tower vendor regarding the safety of the structure. He stated that the proposed location consists <br /> of four vacant lots and a plat was provided. <br /> CellularOne believes that the locations provides plenty of land and there are trees that would <br /> screen the view of tower. A ten foot tall chain link fence would be constructed around the tower <br /> and there would be shrubbery planted around the fence. <br /> Mr. Shampine questioned if the attached ladder reaches all the way to the top of the tower. Mr. <br /> Jungles stated that the ladder rungs can be removed once the tower is constructed and the rungs <br /> can then be stored under lock and key so that children cannot climb the ladder. <br /> Mr. Shampine questioned if the rungs would definitely be removed. Mr. Jungles stated that the <br /> fence would be ten feet high with barbed wire and an alarmed gate. Removal of the rungs is not <br /> a standards procedure but will be done if that is a condition of this tower. <br /> There were no objectors present. <br /> Mr. McQueen presented the recommendation of staff: <br /> The subject petition requests approval of a special use permit to allow the construction and <br /> operation of a monopole communications tower and equipment building on premises commonly <br /> known as 141 Timari Court. The tract in question is vacant and presently platted as four separate <br /> lots; it contains approximately one acre and is zoned R-5 Two Family Residential. Located at <br /> the end of a cul-de-sac street, these four lots are included in a six lot subdivision (Timari <br /> Addition), which was platted in 1979. This addition was originally zoned R-2 Single Family <br /> Residential and subsequently changed to R-5 Two Family. The remaining two lots of the <br /> addition are located to the immediate east and developed with a residential care facility. <br /> While adjoining land on all sides of this tract are zoned single family residential, it should be <br /> noted that the same is relatively isolated from existing development. For example: (1) property <br /> to the north across Timari Court is the rear yards of dwellings fronting on Hill Park Drive or <br /> South Franklin Street Road, (2) property to the east is the side yard for said residential care <br /> facility with the side yard dimension being approximately seventy feet, (3) property to the south <br /> is the rear yard of a dwelling fronting on South Franklin Street Road, and (4) the subject tract is <br />
