COMMUNITY DEVELOPMENT MEMORANDUM
NO. 96-196
November 26, 1996
TO: Honorable Mayor Terry M. Howley and City Council Members
FROM: James L. Williams, Jr., City Manager
George C. Weaver, Director of Community Development .
Robert A. McQueen, Senior Planner`('--5''
SUBJECT: Ordinance Vacating Right of Way for Wildwood Drive West of
Tanglewood Drive
The subject petition requests vacation of that portion of right-of-way for Wildwood Drive lying
west of Tanglewood Drive. As reported by petitioner, the adjoining land to the west and south is
now under ownership of the Decatur Park District; there is no longer any plan for further
residential development west of the subject street. Both the petitioner and the Park District have
requested the subject vacation. A perpetual easement will be retained to operate and maintain a
sanitary sewer located across the westerly portion of the subject street.
Inasmuch as this street was dedicated to the City of Decatur by the petitioner in consideration of
future residential development to the west thereof, said petitioner has requested that they not be
required to obtain an appraisal of the property, but would agree to fair market value
compensation to the City of Decatur. Staff is in agreement with petitioner's request, and based
upon similar requests in other azeas of the City, we recommend approval of a value of
twenty-five cents per square foot resulting in total compensation of$1042.50.
