ORDINANCE NO. 96-71 ��s --�-...,.��oo �h ��C��e� . �IICRQ�'�L�I ORDINANCE VACATING PGRTION OF AN ALLEY � LYING SOUTH OF 919-947 WEST ELDORADO STREET WHEREAS, a request has been received from Wayne L. Bickes and Jerry H. Bickes, owners of property abutting thereon, requesting the vacation by the City Council of that portion of an alley in the City of Decatur, Illinois described as: An alley sixteen (16) feet in width located adjacent and South of Lots Five (5) through Ten (10) in Block One (1) of Dunham's Addition to the City of Decatur, as per Plat recorded in Book 149, Page 113 of the records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, said portion of said alley is no longer useful to the public or to the City or to the owner of the property abutt ing thereon as an alley; and, WHEREAS, the public interest will be subserved by vacating said alley and the public will be relieved from the further burden and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCII, OF TI� CITY OF DECATUR, II,LINOIS: Section l. That the above described portion of alley be, and the same is hereby, vacated as a public a11ey inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said portion of alley being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. That there is hereby reserved in, over, along and under the above-described alley to the City of Decatur, Illinois, and to the public and to those utilities and companies as the case may be owning public service facilities, mains, sewers, telephone and electric or other public utilities, such property, rights of way and easements as are or may be necessary or desirable for
