purpose of refinancing certain indebtedness incurred by the Corporation in connection with the acquisition of two nursing homes located within the City; and WHEREAS, the full and prompt payment of the principal of, premium, if any, and interest on the Series 1988 Bonds was guaranteed by Decatur Memoriai Hospital, an Illinois not for profit corporation (the "Hospital"), pursuant to the Guaranry Agreement dated as of April 1, 1988 between the Hospital and the Series 1988 Trustee; and WHEREAS, the Corporation and the Hospital now desire to advance refund a portion of the Series 1988 Bonds and provide for the payment or redemption of the balance of the Series 1988 Bonds with funds obtained from a loan from the Illinois Health Facilities � ther mone s and aze re uestin the Ci to assist the Corporation and Authoirry and certain o y q S tY the Hospital in accomplishi.ng the same by entering into a First Supplemental Trust Indenture (the "First Supplemental Indenture") with the Series 1988 Trustee, supplementing the Series 1988 Indenture; and WHEREAS, it is in the best interest of the City and in furtherance of the general health and welfare of the residents of the City and the surrounding areas to authorize and approve � the execution and delivery of the First Supplemental Indenture; ' NOW, THEREFORE,BE IT ORDAIlVED by the Council of the Ciry of Decatur, Macon Counry, Illinois, as follows: - SECTION 1. Exercise of Home Rule Powers. The City is a home rule unit under the . provisions of the 1970 Constitution of Illinois, and as a home rule unit may, under the� powers granted by Section 6(a) of Article VII thereof, "exercise any power and perform any function pertain.ing to its government and affairs." This Ordinance is adopted pursuant to the City's home rule powers, any provisions contained in the Illinois Municipal Code to the contrary notwithstanding. . -2- .
