� " 7 <br /> t <br /> ORDINANCE NO. 96-02 <br /> ORDINANCE GRANTING SPECIAL PERMIT <br /> PLANNED UNIT DEVELOPMENT <br /> - 415 EAST ASH AVENUE - <br /> WHEREAS, on the 1 st day of February, 1996, upon due notice, the Decatur City Plan <br /> Commission held a public hearing upon the petition of James Romano for a specia( use pernut for <br /> a B-2 Planned Unit Development on premises situated in the City of Decatur, Illinois, and <br /> described as follows: <br /> All of the following described property except the South 200 feet <br /> thereof: Lot 2 of the North Half(N 1/2) of the Northwest Quarter <br /> (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 26, <br /> Township 17 North, Range 2 East of the 3rd P.M., as per Plat <br /> recorded in Book 149, Page 601 of the records in the Recorder's <br /> Office of Macon County, Illinois, except the South 330 feet of the <br /> West 66 feet of said Lot 2, situated in Macon County, Illinois, <br /> WHEREAS, said Decatur City Plan Commission did report its findings and did <br /> recommend that said petition be granted. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur City Plan Commission be <br /> received, placed on file and approved. <br /> Section 2. That upon the conditions hereinafter mentioned, a special use permit be, and it <br /> is hereby granted to James Romano to develop the premises described above under a B-2 Planned <br /> Unit Development in accordance with the plat and plans hereto attached, marked Exhibit A and <br /> hereby made a part hereof. <br /> Section 3. That prior to issuance of any building pernuts for a specific use, the following <br /> shall be provided: <br /> A. Complete site and construction plans including storm sewers, sanitary sewers, <br /> watermains, fire hydrants, vehicular access, parking lots, streets, landscaping and signage be <br /> submitted to and approved by the Director of Community Development and Director of Public <br /> Works. <br />
