. � ORDINANCE NO. 95-76 ORDINANCE AMENDING CITY CODE - CHAPTER 52 - - ALCOHOLIC LIOUOR - BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the City Code of the City of Decatur be, and the same is hereby, modified and amended by adding a new Section 37 thereto, said Section 37 to provide as follows: 37. No license shall be issued for the sale at retail of any alcoholic liquor within five hundred (500) feet of any church or school, other than an institution of higher learning; provided that, this prohibition shall not apply to hotels offering restaurant service, regularly organized clubs, or to restaurants, food shops or other places where sale of alcoholic liquors is not the principal business carried on. This prohibition shall not apply to locations licensed on December 18, 1995, or to locations where a church or school has been established within 500 feet since the issuance of the most recent license. The distance of 500 feet shall be measured from the property boundary of the licensed premises to the property boundary of the church or school. Section 2. That this Ordinance shall take effect and be in full force on December 18, 1995. Section 3. That the City Clerk be, and she is hereby, authorized and directed to cause the provisions hereof to be appropriately set out in the City Code and to cause the same to be published in pamphlet form according to law.
