. � <br /> ORDINANCE NO. 95-76 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 52 - <br /> - ALCOHOLIC LIOUOR - <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That the City Code of the City of Decatur be, and the same is hereby, <br /> modified and amended by adding a new Section 37 thereto, said Section 37 to provide as <br /> follows: <br /> 37. No license shall be issued for the sale at retail of any <br /> alcoholic liquor within five hundred (500) feet of any church or <br /> school, other than an institution of higher learning; provided that, <br /> this prohibition shall not apply to hotels offering restaurant service, <br /> regularly organized clubs, or to restaurants, food shops or other <br /> places where sale of alcoholic liquors is not the principal business <br /> carried on. This prohibition shall not apply to locations licensed <br /> on December 18, 1995, or to locations where a church or school <br /> has been established within 500 feet since the issuance of the most <br /> recent license. The distance of 500 feet shall be measured from the <br /> property boundary of the licensed premises to the property <br /> boundary of the church or school. <br /> Section 2. That this Ordinance shall take effect and be in full force on December 18, <br /> 1995. <br /> Section 3. That the City Clerk be, and she is hereby, authorized and directed to cause <br /> the provisions hereof to be appropriately set out in the City Code and to cause the same to be <br /> published in pamphlet form according to law. <br />
