� t � � . 1 't I• 'k / ' .�1,1� , �/` '/,.��.!-1 <br /> ' � 1� / <br /> !. ��' /{ `+ /y-'��I � � ;, '!% <br /> � ( / <br /> ORDINANCE NO. 95-74 <br /> ORDINANCE GRANTING SPECIAL PERMIT <br /> PLANNED UNIT DEVELOPMENT <br /> -LAND BOUND BY WEST WOOD STREET, SOUTH OAKLAND AVENUE, <br /> WEST DECATUR STREET AND THE NORFOLK& SOUTHERN RAILROAD - <br /> WHEREAS, on the 2nd day of November, 1995, and the 7th day of December, 1995, <br /> upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of <br /> First Site Commercial Properties, Ltd. and Millikin University for a special use permit for a <br /> Planned Unit Development on premises situated in the City of Decatur, Illinois, and described as <br /> follows: <br /> All of Blocks Two (2) and Three (3) of Oakland Place, as per Plat I, <br /> recorded in Book 149 Page 15 of the records in the Recorder's ' <br /> Office of Macon County, Illinois, including that portion of West <br /> Macon Street lying between said Blocks Two and Three, and the <br /> alleys lying within said Blocks Two and Three, all situated in <br /> Macon County, Illinois; and, <br /> WHEREAS, said Decatur City Plan Commission did report its findings and did <br /> recommend that said petition be granted. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur City Plan Commission be <br /> received,placed on file and approved. <br /> Section 2. That upon the conditions hereinafter mentioned, a special use permit be, and it <br /> is hereby granted to First Site Commercial Properties, Ltd. and Millikin University to develop <br /> the premises described above under a Planned Unit Development in accordance with the plat and <br /> plans hereto attached, marked Exhibit A and hereby made a part hereof. <br /> Section 3. That prior to issuance of any building permits procedures shall be completed <br /> to vacate those portions of public alleys and streets within the proposed development, and <br /> further, that easements for public utilities shall be granted to accommodate construction of new <br /> utility lines. <br />
