COMMUlvITY DEVELOPMENT MEMORANDUM <br /> NO. 95-272 <br /> December 13, 1995 <br /> TO: Honorable Mayor Terry M. Howley and City Council Members <br /> FROM: James C. Bacon, Jr., City Manager �� <br /> George C. Weaver, Director of Community Development����� <br /> SUBJECT: Ordinance Rezoning Property at 3601 Route 36 East �I <br /> The subject petition requests that Lot 1, Decatur Plaza Subdivision be rezoned from B-1 � <br /> Neighborhood Commercial to B-2 General Commercial District. The purpose of the proposed <br /> zoning change is to allow for the proposed construction of an automobile lubrication station. The <br /> zoning change request is required due to the limitation on number of employees permitted under a <br /> B-1 classification on any single shift. The petitioner expects that the number of employees to be <br /> hired will exceed the maximum number of five and therefor requires the change from B-1 to B-2. <br /> Upon review of the land use and zoning patterns in the general area, staff noted that property is <br /> located in the northwest corner of the Decatur Plaza Subdivision. It is noted that property to the <br /> north and west is zoned R-2, and generally R-1 to the south and east of the larger subdivision <br /> tract. More specifically the tract is bounded by R-1 uses except for the westerly boundary which <br /> is zoned R-2. <br /> In considering the compatibility of the proposed use with the surrounding area, staff is of the <br /> opinion that the proposed change in zoning classification will not adversely affect adjacent uses. <br /> Staff agrees with the petitioners opinion that the proposed change would neither affect the <br /> appearance, noise, or traffic levels of the neighborhood. The petitioner represents he will <br /> construct an attractive structure that will be compatible with the neighborhood including the <br /> property to the west. But for the maximum number of employees provision of the ordinance, this <br /> proposed use of lot one would not require any planning commission or council action. Staff <br /> recommends approval of the petition as presented. <br />
