. • �. � ORDINANCE NO. 95-70 ORDINANCE AUTHOR�ZING LAND ACQUISITION - SANTTARY SEWER EXTENSION- - CTTY PROJECT - WHEREAS, the City of Decatur, Illinois, owns and maintains a sewerage system for the collection and disposal of sewage and industriat wastes; and, WHEREAS, the Council of said City intends to extend a portion of said sewerage system under and through the following described premises: The North Half(N'/z) of the Northeast Quarter (NE '/4) of Section 28 and also the North Half(N'h) of the North Half(N'/2) of the Southwest Quarter(SW'/<) of said Northeast Quarter (NE'/<) of said Section 28, all in Township 17 North, Range 2 East of the 3rd P.M., containing 90 acres, more or less, situated in Macon County, Illinois. which premises are suitable and desirable for the location and construction of said extension; and, WHEREAS, it is necessary and desirable that an easement under and through said premises, appropriate for the purposes hereof, be acquired by said City. NOW, TI�REFORE, BE IT ORDAINED, BY TI� CITY COUNCII, OF TI-� CITY OF DECATUR, II.LINOIS: , Section 1. That it is, and it is hereby determined to be, necessary and desirable that the City, in order to extend said sewerage system as aforesaid, acquire an easement for such purpose under and through the real property described above. Section 2. That it is hereby deternuned that the aforesaid easement, and the acquisition thereof, is necessary for a public use and purpose. Section 3. That the City Manager and the Corporation Counsel,jointly and severally, be, and they are hereby, authorized and directed to cause said easement to be acquired on behalf of the City, and in the event the same is not able to be acquired by agreement with the owner or owners of said premises upon the compensation or consideration to be paid or furnished for the same, or in the event title thereto is defective, then title to and possession of said easement shall
