McQueen, Senior Planner <br /> SUBJECT: Sale of land at Stella Drive and Martin Luther <br /> King, Jr. Drive <br /> An ordinance authorizing sale of excessive street <br /> right-of-way at the northeast corner of Stella Drive and <br /> North Martin Luther King, Jr. Drive is scheduled for review <br /> and action by the City Council on Monday, November 20, 1995. , <br /> Containing 6000 square feet, the area in question is the �� <br /> east sixty feet of Lot One (1) of W. R. Edward's First <br /> Addition. This lot in its entirety was purchased as a <br /> vacant lot by the City of Decatur in June, 1993 to <br /> accommodate widening of Ma.rtin Luther King, Jr. Drive. <br /> All street construction and related improvements at the <br /> subject intersection have been completed. Further, the <br /> City of Decatur Engineering Division has surveyed the lot in <br /> question and determined the area proposed for sale is <br /> excessive right-of-way. <br /> Inasmuch as the purchaser has indicated his plan to <br /> construct a detached garage on the subject area, the subject <br /> ordinance restricts future use of the property to such <br /> construction to serve an adjoining single family residence; <br /> compliance with the City of Decatur Subdivision Ordinance <br /> would be necessary to join this tract with the purchaser' s <br /> � existing lot prior to construction of a garage. The <br /> purchaser has been advised of this requirement. <br /> The offer of $2500. 00 to purchase this tract is proportionally <br /> in line with the original price of the lot paid by the City <br /> of Decatur; therefore, no new appraisal for the same was <br /> required. <br /> Staff recommends approval of the ordinance as submitted. <br />
