•.. ♦ • <br /> ORDINANCE NO. �-�— <br /> ORDINANCE REVERSING A DECISION OF THE <br /> ZONING BOARD OF APPEALS <br /> - 1404 NORTH WATER STREET- � <br /> WHEREAS, on May 11, 1995, pursuant to notice as required by statute, the Decatur <br />' Zoning Board of Appeals held a public hearing upon the petition of Warren E. Danz for a <br /> variation in the si a e re lations of the Zonin Ordinance of the Ci of Decatur to allow a free <br /> � g � g �Y <br /> standing advertising sign seventeen (1'7) feet in height and fifly-sUc (56) square feet in area on <br /> premises commonly known as 1404 North i�Vater Street; a maximum height of ten feet and area of <br /> thirty-five (35) square feet for said sign is permitted. Said premises are legally described as <br /> follows: <br /> The North 82.75 feet of the West 150 feet of Lot Ten (10) of <br /> Mattie E. Blaine's Subdivision of Lots Seven (7) and Eight (8) in <br /> Block Three (3) of Lake & Co.'s Addition of Outlots as per Plat <br /> recorded in Book 22 Page 594 of the records in the Recorder's <br /> Office of Macon County, Illinois; and, <br /> WHEREAS, after due consideration and upon an affirmative vote of less than five (5) <br /> members thereof, said Zoning Board of Appeals did deny the prayer of said petition and did refuse <br /> to vary the provisions of said Zoning Ordinance; and, I <br /> WHEREAS, Warren E. Danz has timely filed an appeal of said Boazd decision with the <br /> City Clerk, pursuant to Section X��(D) of the Zoning Ordinance, seeking a determination by <br /> this Council that a free standing advertising sign having a height of seventeen(17)feet and area of <br /> thirty-five (35)feet is acceptable. <br /> NOW, TI�REFORE, $E IT ORDAINED, BY TI� CITY COUNCIL OF TI� CITY <br /> OF DECATUR, ILLINOIS: <br /> � <br /> Section 1. That the appeal of Warren E. Danz, as described herein be, and the same is ' <br /> hereby, received, placed on file and approved, and the aforesaid decision of the Zoning Board of <br /> Appeals be, and the same is hereby, disapproved and reversed. i <br /> Section 2. That the requested variation in the aforesaid setback requirement to allow a <br /> free standing advertising sign having a height of seventeen (17) feet and area of thirty-five (35) <br /> square feet, as requested by petitioner, be, and the same is hereby, allowed and the Building <br />
