McQueen, Senior Planner <br /> SUBJECT: Reversing Decision of the Zoning Board of Appeals <br /> regarding 1404 North Water Street <br /> An ordinance reversing the decision of the Zoning Board of <br /> Appeals regarding a proposed free standing sign at 1404 <br /> North Water Street is scheduled for review and action by the <br /> City Council on Monday, September 18, 1995 . <br /> On Thursday, May 11, 1995, the Board denied a petition by <br /> Warren E. Danz to allow construction of a free standing <br /> advertising on said premises with such sign being seventeen <br /> (17) feet in height and containing fifty-six (56) square <br /> feet in area; a sign having a maximum height of ten (10) <br /> feet and maximum area of thirty-five (35) square feet is <br /> permitted. The Board' s motion to approve the subject <br /> petition failed to carry as one member voted in favor of the <br /> motion and three members voted against the motion. <br /> In accordance with Section XXIII of the Zoning Ordinance, <br /> the concurring vote of four members of the Board shall be <br /> necessary to decide in favor of the petitioner. Further, <br /> said section stipulates that any decision of the Board with <br /> less than five affirmative votes is subject to appeal to <br /> the City Council by the party aggrieved if such appeal is <br /> filed with the City Clerk within ten days after the decision <br /> � of the Board is given. The subject petitioner has timely <br /> filed such appeal requesting City Council review and action. <br /> Attached hereto is a copy of the minutes for said hearing <br /> which include staff recommendation. Also, the attached plat <br /> . designates by cross hatched lines the vision clearance area <br /> within which a free standing sign would be prohibited. <br /> Otherwise, the sign size and height as set forth by the <br /> Zoning Ordinance would be permitted within any area west of <br /> the existing building. <br />
