COMMUNITY DEVELOPMENT MEMORANDUM
NO. 95-181
July 26, 1995
TO: Honorable Mayor Terry M. Howley and City Council Members
FROM: 7ames C. Bacon, Jr., City Manager
William B. Turner, Acting Director of Community Development
obert A. McQueen, Planner
SUB7ECT: Ordinance Rezoning 2228 East Prairie Street
The subject petition requests rezoning of premises commonly known as 2228 East Prairie Street
from R-3 Single Family Residence District to B-1 Neighborhood Shopping District. Presently
platted as two separate lots, the area in question is developed with a parking lot which previously
served a restaurant. The esting parking lot was developed some years ago after review and
approval of the same by the Decatur Zoning Board of Appeals. The purpose of the proposed
zone is to enable construction of a new convenience store and service station operation.
Upon review of nearby zoning patterns, staff noted that adjoining property to the east and north is
zoned B-2 Commercial; this zone was established in 1985 to enable serving liquor at a previous
restaurant facility. Prior to said B-2 zone, this adjoining area was zoned B-1.
Staff is of the opinion that the proposed zone is in keeping with land use and zoning patterns in
the general area of the intersection of North 22nd Street and Route 36. Further, we note that the
Comprehensive Land Use Plan ca11s for commercial development of the entire area bounded by
North 22nd Street, Prairie Street, and Route 36.
In view of the above data, staff recommends approval of the petition as presented.
