i � . <br /> ORDINANCE NO. / �— � �— <br /> AN ORDINANCE VACATING A STREET <br /> - CLUBVIEW DRIVE- <br /> WHEREAS, a request has been received from the owners of properties abutting thereon <br /> requesting vacation by the City Council of the street known as Clubview Drive, said street being <br /> more particularly described as foll�ws: <br /> SEE EXF��BIT A ATTACHED HERETO AND <br /> HEREBY MADE A PART HEREOF; and <br /> WHEREAS, said street is no longer useful to the public or to the City; and, <br /> WHEREAS, the public interest will be subserved by vacating said street and the public <br /> will be relieved from any further burden or responsibility for maintaining said street. <br /> NOW, TI�REFORE, BE IT ORDAINED, BY TF� CITY COUNCIL OF TI-� CITY <br /> OF DECATUR, II.LINOIS: <br /> Section l. That the above described street be, and the same is hereby, vacated as a public <br />' street inasmuch as the same is no longer required for public use and the public interest will be <br /> subserved by such vacation, said street being shown on the plat thereof hereto attached and <br /> hereby made a part hereof. <br /> Section 2. That there is hereby reserved in, over, along and under the above-described <br /> street to the City of Decatur, Illinois, and to the public and to those utilities and companies as the <br /> case may be owning public service facilities, mains, sewers, telephone and electric or other public <br /> utilities, such property, rights of way and easements as are or may be necessary or desirable for <br /> continuing public service by means of such facilities and for the maintenance, renewal and <br /> reconstruction thereof with the right of ingress and egress for such purposes. <br /> Section 3. That the benefits which will be accrued to the owners of abutting properties by <br /> reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the <br /> sum of Two Thousand Dollars ($2,000). <br /> Section 4. That the vacation herein provided for is made upon the express condition that <br /> there shall be paid to the City of Decatur, Illinois, by or on behalf of the owners of the properties <br />
