' , t <br /> FAP Route 714 (Illinois Route 48) <br /> Section 127TS <br /> Macon County <br /> Job No. C-95-096-93 <br /> Agreement No. JN-594011 <br /> Contract No. 90590 <br /> AGREEMENT <br /> This agreement, entered into this 16 � day of November , A.D. 2000 , by <br /> and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF <br /> TRANSPORTATION hereinafter called the STATE, and the City of Decatur, in Macon <br /> County, of the State of Illinois, hereinafter called the CITY. <br /> WITNESSETH <br /> WHEREAS, the STATE in order to facilitate the free flow of traffic and insure safety <br /> to the motoring public, is desirous of installing new traffic signals at the intersection of Illinois <br /> Route 48 (FAP Route 714) with Rock Spring Drive, primarily consisting of installing new <br /> signal posts, signal heads, a new controller, controller cabinet, detector loops, and installing <br /> electric cable for the Railroad Interconnect System; and by performing all other work <br /> necessary to complete the improvement in accordance with approved plans and specifications; <br /> and <br /> WHEREAS, the CITY is desirous of said improvement in that same will be of <br /> immediate benefit to the CITY's residents and permanent in nature, and; <br /> NOW, THER�FORE, in consideration of the mutual covenants contained herein, the <br /> parties agree as follows: <br /> 1. The STATE agrees to make the surveys, obtain all necessary rights of way, <br /> prepare plans and specif�cations, receive bids and award the contract, furnish <br /> engineering inspection during construction and cause the improvement to be <br /> built in accordance with the plans, specifications, and contract. <br /> 2. The STATE agrees to pay all rights-of-way, construction and engineering costs <br /> subject to reimbursement by the CITY. The STATE will negotiate and <br /> coordinate with Norfolk Southern Railroad for the adjustment of their railroad <br /> facilities. <br /> -1- <br />
