attorney's fees, with interest on such costs and eYpenses at the rate of nine percent(9%) per <br /> annum, from the date of each expenditure by Contractor until paid by the City. <br /> 12.10 Con�ractor shall be responsible for damages on public or private property resulting from. <br /> careless operation of vehicles or careless handling of any receptacle. All properry which suffers <br /> damage (reasonable wear-and-tear excepted) caused by the Contractor shall be repaired or <br /> � replaced as soon as possible to equivalent quality at the time of the damage, and at no extra <br /> charge to the properry owner. If the Contractor fails to do so within a reasonable period of time <br /> the City of Decatur may, after forry-eight (48) hours and after giving the contractor notice in <br /> writing, proceed to repair or replace such properry as may be deemed necessary at the <br /> Contractor's e3cpense. The Contractor agrees to pay for said expenses within ten(10) days of <br /> receipt of said invoice. � <br /> XIII. MISCELLANEOUS <br /> 13.1 Contractor shall not be responsible for the collection of items that are not properly <br /> prepared provided that the collector places a sticker on any item(s) not collected indicating the <br /> reason why it could not be collected. Preparation requirements include rinsing materials and <br /> separating them into paper or plastic bags. Residents are responsible for placing containers close <br /> to the curb (or in those areas without curbs, placing them in an equivalent position) so that they <br /> aze easily accessible to the collector. ; <br /> 13.2 During the term of a contract, the Contractor shall comply in all respects with the Equal <br /> Employment Opportunity ActlIllinois Human Rights Act. Findings of noncompliance with <br /> applicable State or Federal Equal Employment Opportunity Laws or regulations may be sufficient <br /> reason for revocation or cancellation of the contract. <br /> 13.3 The Contractor shall not assign or subcontract this agreement and contract, or the work <br /> thereof, to any person, firrn, or corporation without prior written consent of the City, however, <br /> Contractor may perform its obligations thereunder through its subsidiaries or divisions. Such <br /> assigrunent shall not relieve the Contractor from its obligations or change the tenns of this <br /> agreement or a contract. <br /> 13.4 At all times and for all purposes, the Contractor is an independent contractor and not an <br /> employee of the City. No statements shall be construed so as to find the Contractor an employee <br /> of the City. No employee of the Contractor shall be an employee of the City. <br /> 13.5 Contractor(s) shall comply with all Federal, State, County and local laws, ordinances, and <br /> regulations governing the collection, disposal, and processing of recyclables. <br /> 13.6 Contractor shall be aware of current and impending State of Illinois deadlines established <br /> by legislation for implementation of restrictions on disposal of certain recyclables_ <br /> 15 <br />
