The STATE's normal participation in cost would be: <br /> A. The total of the matching funds (10%) for all participation items except the signal <br /> modernization. <br /> B. Half of the matching funds (5%) for traffic signal modernization. <br /> *The CITY is to pay for all costs that exceed $652,000. The CITY's normal participation in <br /> cost would be: <br /> A. None of the matching funds (10%o) for all participation items except the signal <br /> modernization. <br /> B. Half of the matchin funds (5%) for traffic signal modernization. <br /> g <br /> The project cost estimate indicates the matching portion of work qualified for Federal funds <br /> will exceed the maximum reimbursement of$652,000. <br /> Participation and reimbursement shall be predicated by the percentages shown or outlined <br /> above for the specified work. Cost shall be determined by multiplying the final quantities <br /> times contract unit prices. Participation provided by the STATE will be limited to a maximum <br /> reimbursement of$652,000. <br /> The STATE further agrees that upon final execution of this agreement, upon receipt of contract <br /> obligation document, upon award of the contract for this improvement, and upon receipt of <br /> satisfactory invoices from the CITY, for the same, the STATE will pay the CITY in a lump <br /> sum from any funds allotted to the STATE, an amount equal to 95% of its obligation incurred <br /> under this AGREEMENT, and will pay the said CITY the remainder of the obligation in a <br /> lump sum, upon completion of the project subject to the maximum reunbursement of <br /> $652,000. <br /> 4. The CITY agrees to acquire in its name and at its own expense, subject to <br /> reimbursement as hereinafter provided, all right of way necessary for this project in <br /> accordance with the requirements of Titles II and III of the Uniform Relocation <br /> Assistance and Real Property Acquisition Policies Act of 1970, as amended. The <br /> requirements of Title II and Title III shall be carried out in accordance with established <br /> State Policies and Procedures, as now or hereafter revised or amended. Prior to the <br /> CITY's advertising for bids, the local agency shall certify to the STATE that all <br /> requirements of Titles II and III of said Uniform Act has been complied with. <br /> A. The CITY will advertise for bids for the construction of the proposed <br /> improvement after the local agency's certification as to compliance with Titles II <br /> and III requirements have been accepted by the STATE and subject to approval , <br /> by the Division Administrator of the Federal Highway Administration. <br /> B. The STATE shall provide such guidance, assistance and supervision and ' <br /> monitor and perform audits to the extent necessary to assure validity of the local � <br /> agency's certification of compliance with Titles II and III requirements of the I� <br /> aforesaid Act.
