Kriege ssistant City Manage <br /> Sub�ect: Leaf-vacuumi� A eement with Suburban Dis osal &Rec clin <br /> J g �' P Y g <br /> Approval of the attached agreement with Suburban Disposal & Recycling will provide for an <br /> October 15, 2000, implementation of a city-wide leaf vacuuming program. As Council will <br /> recall, the implementation of a city-wide program was discussed during the July 24, Study <br /> Session. At Council's direction, the attached agreement with Suburban Disposal and Recycling <br /> was prepared; as well as an agreement with Decatur Community Partnership/Turning Point for <br /> continuation of the leaf raking project. <br /> During the July 24, 2000, discussion, Council raised several points regarding the operation of the <br /> program that are contained within the agreement. The following is a summary of the major <br /> provisions of the agreement: <br /> 1. The term of the agreement is five years, beginning October 1, 2000, through September 30, II <br /> 2005. � <br /> 2. Suburban will provide eight leaf vacuum pick-ups each year, during an October 15-December ' <br /> 31 collection period. <br /> i. Suburban will establish and provide a schedule for the vacuum pick-ups by August ' <br /> 15, of this year, and August l, each year thereafter. <br /> ii. Leaf collection will only occur between the hours of 7:00 AM - 7:00 PM. <br /> 3. Suburban shall keep on file with the City the name and address of the disposal site utilized. <br /> 4. Suburban shall keep accurate records regarding the total weighUvolume of leaves collected, <br /> as well as program participation rates. <br /> 5. If Suburban operates a compost/mulching facility, it will provide the City compost/mulch at <br /> no charge. <br /> i. Should Suburban engage in the sale of leaves and/or compost/mulch material, the City <br /> shall be entitled to 25 % of the gross receipts from sales in excess of$200,000. <br /> 6. The City will have the right to terminate the agreement prior to the beginning of any <br /> collection period, subject to the agreed upon termination fee schedule. <br /> 7. For provision of leaf vacuuming services, Suburban will receive annual payments of <br /> $403,200. <br /> i. In addition to the annual payments described above, Suburban will receive a one-time <br /> front-end payment of not more than $250,000, for reimbursement of necessary costs <br /> to ensure an October 15, 2000, implementation date. <br />
