AGREEMENT <br /> This AGREEMENT made by and between the City of Decatur, Illinois, ("City"), a municipal <br /> corporation, and Real Estate Investors of Decatur,L.L.C.,("REID"). <br /> WHEREAS, the City owns and operates a public parking lot located at the Southeast Corner of <br /> Main and Main Streets. ("Parking LoY'), and <br /> WHEREAS, REID owns the premises adjacent to the parking lot and commonly known as <br /> follows: 111 E. Main Street, ("Premises) and, <br /> WHEREAS, REID wishes to have vehicular access to the Parking Lot from and through the <br /> Premises for tenants and guests thereof, and the City is willing to grant such access on the terms and <br /> conditions set out below. <br /> NOW, THEREFORE, for and in consideration of the provisions contained herein, the City and <br /> REID agree as follows: <br /> 1. The City hereby covenants to REID that motor vehicles belonging to, or driven by, tenants, <br /> guests, customers and other invitees of those firms or businesses located on the Premises, excluding <br /> service and delivery vehicles, shall have access to East Main Street over and through the Parking Lot for <br /> the term of this Agreement. <br /> 2. The point of access from the Premises to the Parking Lot, and the design thereof, shall be <br /> approved by the Director of Public Works. <br /> 3. At such time as the City, in its discretion, repairs or replaces the surface of the Parking Lot, <br /> excluding ordinary maintenance, REID shall reimburse the City for Twenty Five Per Cent (25%) of the <br /> cost thereof within thirty(30) days of receipt of an invoice for same. <br />� <br />
