. � <br /> termination, rates of pay or other forms of compensation;and selection for training, including <br /> apprenticeship. In addition,the Grantee agrees to comply with any implementing requirements FTA may <br /> issue. <br /> b. EEO Program Incorporated by Reference. If the Grantee is required to submit and obtain approval of its <br /> EEO program,that EEO program approved by the Government is incorporated by reference and made <br /> part of this Agreement. Failure by the Grantee to carry out the terms of that EEO program shall be <br /> treated as a violation of this Agreement. Upon notification of its failure to carry out the approved EEO <br /> program,the Government may impose such remedies as it considers appropriate, including termination <br /> of financial assistance, or other measures that may affect the Grantee's eligibility to obtain future <br /> financial assistance in transportation projects. <br /> 2. Ac�e. In accordance with 29 U.S.C.§623 and 49 U.S.C. §5332,the Grantee agrees to refrain from <br /> discrimination against present and prospective employees for reasons of age. The Grantee further agrees to <br /> comply with the applicable requirements of the Age Discrimination Act of 1975,as amended,42 U.S.C. <br /> Sections 6101 through 6107. In addition,the Grantee agrees to comply with any implementing regulations <br /> FTA may issue. <br /> 3. Disabilities. In accordance with 42 U.S.C.§ 12112,the Grantee agrees that it will comply with the <br /> requirements of 29 C.F.R. 1630, pertaining to the employment of persons with disabilities. In addition,the <br /> Grantee agrees to comply with any implementing regulations FTA may issue. <br /> 4. Sex: In accordance with Title IX of The Educational Amendments of 1972,as amended,20 U.S.C., Sections <br /> 1681, 1683 and 1685 through 1687, Grantee agrees to comply with prohibitions against discrimination on the <br /> basis of sex, and any Federal requirements that may be promulgated. <br /> C. Illinois Human Rights Act . The Grantee shall comply with the"Equal Employment Opportu�ity Clause"required <br /> by the Illinois Department of Human Rights. It is understood that the term"contractor"shall also mean"Grantee." <br /> The Equal Employment Opportunity Clause reads as follows and shall apply to the Project: <br /> In the event of the Grantee's non-compliance with any provisions of the Illinois Equal Employment I <br /> Opportunity Clause,the Illinois Human Rights Act Rules and Regulations of the Illinois Department of I <br /> Human Rights(hereinafter"Depa�tmenY'for this subsection only),the Grantee may be declared ineligible <br /> for future contracts or subcontracts with the State of Illinois or any of its political subdivisions or municipal <br /> corporations, and the Agreement may be canceled or voided in whole or in part,and such other sanctions <br /> or penalties may be imposed or remedies invoked as provided by statute or regulation. During the <br /> performance of this Agreement,the Grantee agrees as follows: <br /> 1. That it will not discriminate against any employee or applicant for employment because of race,color, <br /> religion, sex, national origin,ancestry,age, physical or mental handicap unrelated to abiliry,or an <br /> unfavorable discFiarge from military service; and further that it will examine all job classifications to <br /> determine if minority persons or women are underutilized and will take appropriate affirmative action to <br /> rectify any such underutilization. <br /> 2. That, if it hires additional employees in order to perform this contract or any portion thereof, it will - <br /> determine the availability(in accordance with the DepartmenYs Rules and Regulations)of minorities and <br /> women in the area(s)from which it may reasonably recruit and it will hire for each job classification for <br /> which employees are hired in such a way that minorities and women are not underutilized. <br /> 3. That, in all solicitations or advertisements for employees placed by it or on its behalf, it will state that all <br /> applicants will be afforded equal opportunity without discrimination because of race,color, religion, sex, <br /> national origin or ancestry, physicat or mental handicap unrelated to ability,or an unfavorable discharge <br /> from military service. <br /> State/Federal Capita!Grant page 21 ' <br />
