The monthly fee shall be in effect as of the earliest date of any District <br /> radio was programmed to work within the System. <br /> (b) It is agreed between both parties that the moneys collected as a result of this <br /> agreement will be utilized by the City to restore the capacity of the System that was <br /> utilized by the addition of non-City radios, and that once such required capital <br /> improvements have been made the monthly charge for radio usage to the Decatur Park <br /> District Rangers will be adjusted to equal the prorated charge assessed to all City users <br /> of the System. The need for capital improvements ar additions shall be solely in the <br /> discretion of the City. <br /> O It is agreed that the City of Decatur will provide to the executive officer of <br /> the Decatur Park District Rangers a written report on a quarterly basis reporting the <br /> status of the account in relation to the funds collected and expended and providing an <br /> e�lanation of the nature of the expenses related to this account. <br /> 4. The City reserves the right to deny any radio or radios operated by the District <br /> access to the System at any time if the use thereof by the District in any way hampers <br /> the operation or security of the System or the use thereof by other agencies or is in <br /> violation of this agreement or any FCC regulations. Said access can be denied without <br /> prior warning, however, the City agrees to provide a statement in writing within 10 <br /> business days as to what access was removed or denied and the basis for such action <br /> to the chief executive of�icer of the affected agency. <br /> In such case, the District shall reimburse the City for all costs incurred in removing <br /> such radio or radios from the System, including but not limited to fees charged by <br /> independent contractors and wages paid to City employees for time spent removing <br /> said radio or radios. The City shall furnish the District a written e�lanation of the need <br /> for such removal within ten(10) business days of denial of access. <br /> 5. The softwaze keys necessary to access the System shall remain the property of <br /> the City, and use of said keys by any persons, firms or corporations working on behalf <br /> of the District, whether to service radios or otherwise, must be approved by the City. <br /> 6. (a)Every radio of the District using the System shall have a unique electronic <br /> code number("PVT Number") created and assigned by the City. <br /> (b) The District shall supply the City with the following inforn�ation on every <br /> radio authorized for access to the System: type of radio, model number, serial number <br /> and"PVT number". <br /> 7. Access to the System shall only be authorized for radios that match the <br /> configuration of the System, and all such radios sha.11 have the ability to inhibit a radio <br />, by use of System software. Existing radios may be programmed into the System that <br /> do not meet the terms of this paragraph at the time of the signing of this agreement, <br />�I <br />
