Morthland, Corporation Counsel <br /> SUBJECT: Resolution Authorizing Transfer—Board of Library Trustees <br /> SUMMARY RECOMMENDATION: City Administration recommends City Council <br /> approval of the transfer of the Decatur Public Library property located at 130 North Franklin <br /> Street, Decatur, Illinois from the Board of Library Trustees of the City of Decatur to the City of <br /> Decatur. <br /> BACKGROUND: The Decatur Public Library occupies a square city block of property <br /> directly located in the central business district of the City. Title to the property is held by the <br /> Board of Library Trustees of the City of Decatur, Illinois. The City of Decatur is still paying <br /> bond debt for the purchase of that building and paying rent to the Library for records storage <br /> space. <br /> The Buildings located on that property contain more space than the Library utilizes. Regardless <br /> of the occupancy, however, the Library still has the obligation to maintain the entirety of the <br /> property. The financial and time constraints required to adequately manage and maintain the <br /> building and property created issues for the Decatur Public Library and they began actively <br /> seeking solutions. The City and Decatur Public Library have spent a great amount of time <br /> attempting to reach a solution to those issues. Title to the Library property would be transferred <br /> to the City of Decatur and a Lease between the parties would be simultaneously entered into. <br /> There would be no actual monetary transfer between the parties for the transfer of title. The <br /> unused space will still be available for use by others, including the County of Macon. <br /> If both the transfer of the property and Lease Agreement are approved by Council, it is <br /> anticipated that the Lease would begin May l, 2016. <br /> ATTACHMENTS: Resolution <br />
