G. The bus shall display signs identifying it as a special route bus, but it shall <br /> not display any sign relating to ti�e Church. <br /> 3. The vehicle used by the City to provide said public transportation shall be one of <br /> the transit coaches owned and operated by the Decatur Public Transit System, and <br /> shall be capable of accommodating at least 30 seated, adult passengers. The City <br /> shall attempt to provide the largest transit coach available. <br /> 4. The bus will make two complete circuits each day, as shown on the attached route <br /> map and schedule (Exhibit C). <br /> 5. The Church agrees to subsidize the City for the provision of the transportation <br /> service described herein on a per hour basis, to the nearest quarter hour, with four <br /> (4) hours being the mandatory minimum per day. The Church shall only be <br /> chazged for the time that the bus is used making the route, and not for the time <br /> between routes. The chazge per hour shall be $54.00; the minimum charge per <br /> day shall be $216.00. <br /> 6. The Church shall be required to pay for only the service provided, under the <br /> limitations of Section 5 above. The Church shall not be required to pay for <br /> service that is not provided due to the failure of the City to perform for any <br /> reason. <br /> 7. The City shall submit a monthly report to the Church showing, by day, the <br /> number of passengers carried, the actual hours of vehicle usage, and other <br /> information as the Church may reasonably request. <br /> 8. The City shall bill the Church on a calendar month basis, for the time that the <br /> vehicle was used to provide said service during the month. The Church shall <br /> make payment within fifteen (15) calendar days of receipt of said bill. <br /> 9. The City shall be excused for failure to perform services under this agreement if <br /> said service is prevented by reason of Acts of God, strikes, labor disputes, or other <br /> occurrences over which the City has no control. <br /> 10. DEFALTLT: <br /> A. The following are events of default hereunder: (a) non-payment of any <br /> amount due the City hereunder within thirty (30) days of the due date; <br /> (b)the City's nonperformance under any provision hereof within ten(10) <br /> days after the Church has made written demand therefor; (c)the Church's <br /> bankruptcy, receivership, insolvency, assignment for the benefit of the <br /> creditor's or similaz action or condition relating to the Church or the <br /> Church's property which causes the City in good faith to deem itself <br /> insecure with respect to the collection of any amount due. <br />
