TALBOTT of Decatur, Illinois, and states <br /> as follows : <br /> 1 . That the undersigned is the duly elected and presently <br /> acting Highway Commissioner of Decatur Township Road District, <br /> Macon County, Illinois, having been elected and serving in such <br /> office pursuant to the Illinois Highway Code Sections 6-113 and 6- <br /> 116 (560 ILCS 5�6-113 and 5/6-116) . <br /> 2 . That Decatur Township Road District is a unit of local <br /> government within the definition contained in the Constitution of <br /> the State of Illinois at Article VII thereof . That the Statutory <br /> Organizational Authority of said Road District is contained in the <br /> Illinois Highway Code Section 6-2 ( 605 ILCS 5/6-102 ) . That a <br /> Township Road District in Illinois is a unit of local government <br /> separate and distinct from any other unit of local government, <br /> including that of a Township. Western Sand & Gravel, Co. v. Town <br /> of Cornwall, 2 Ill. 2 (d) 560; Roesch-Zeller, Inc. v. Hollembeak, et <br /> al, 5 Ill. App. 2 (d) 94 . <br /> 3 . That, pursuant to the Illinois Highway Code at Section 6- <br /> 201 . 5 and 6-501, a Road District, including the Decatur Township <br /> Road District, is a district with the power to levy taxes ( 605 ILCS <br /> 5�6-201 .5 and 5�6-501) and therefore is a "Taxing district" within <br /> the meaning of the Tax Increment Allocation Redevelopment Act <br /> ( "TIARA" ) at Section 11-74 . 4-2 . (t) ( 65 ILCS 5/11-74 . 2-2 . (t) ) . That <br /> one-half of the taxes levied by the Decatur Township Road District <br /> are paid annually to the City of Decatur Treasurer pursuant to the <br /> Illinois Highway Code 6-507 ( 605 ILCS 5�6-507 ) . That taxes have <br /> been levied by Decatur Township Road District, as a separate unit <br /> of local government, at least since before the year 1960 . <br /> 4 . That all of the real estate located within the "Olde <br /> Towne Redevelopment Project Area" ( "Redevelopment Project Area" ) is <br /> located within Decatur Township Road District, a unit of local <br /> government and a Taxing district as defined in the Tax Increment <br /> Allocation Redevelopment Act. <br />
