AMENDMENT TO AGREEMENT This Amendment to Agreement is made by and between the City of Decatur, Illinois ("Cit�'), a municipal corporation, and Blackstone Crroup, ("Blackstone"), an Illinois general partnership. 1. That the Agreement between the City and Blackstone, approved by the City Council of the City of Decatur on April 26, 1999 by Resolution No. R99-66, is revised at paragraph 1 thereof. Said revised paragraph 1 to provide as follows: 1. Blackstone sha11 develop the Premises in accordance with Exhibit A to Ordinance No. 99-52, which ordinance placed the Premises in a B-3 Planned Shopping Center District, provided that a11 necessary permits are obtained from the City's Departments of Public Works and Economic and Urban Development prior to any construction. 2. That said Agreement between the City and Blackstone, is further revised at paragraph 2 thereof. Said revised paragraph 2 to provide as follows: 2. As shown on said E�ibit A, those buildings identified as listed herein shall contain those retail operations doing business under the names and listed opposite each, such retail operations to be open for business not later than June 1, 2001: Building C - Circuit City Building D -Walgreens Drug Store It is expressly understood by the parties hereto that the construction and opening of the retail establishments named herein, by the dates listed, is a condition precedent to any reimbursement to Blackstone as provided hereinafter. 3. That said Agreement between the City and Blackstone, is further revised at paragraph 3 thereof. Said revised paragraph 3 to provide as follows: 3. All buildings located on the Premises shall be constructed with brick facades, as approved by the Director of Economic and Urban Development. 1
