7. The City shall promote the Program via radio,newspaper, informational brochures, and various other media as deemed necessary. 8. The City shall determine the cash fare to be paid by Program participants and reserves the right to change that rate. , 9. The Cab Company shall be excused for failure to perform services under this Agreement if said service is prevented by reason of Acts of God, strikes, labor disputes, or other occurrences over which the Cab Company has no control. 10. If during the course of this Agreement, the Cab Company fails or refuses to provide transportation services for the Program for reasons other than those specified above, the City may at its option assess the Cab Company an amount not to exceed $100.00 per day as damages from the date of discontinuance of service to the date that service is reinstituted. 11. This Agreement may be modified periodically by mutual agreement of both parties in order to meet the changing transit needs of Decatur or to create greater operating efficiency. 12. This Agreement shall terminate if the franchise or the license of the Cab Company to operate taxi-cab service in the City is suspended or revoked. 13. The City reserves the right to terminate this Agreement prior to the time specified herein if there is a reduction or loss of federal funding that supports the Program, provided that the Cab Company is notified sixty (60) days in advance of such action.
