If, before settlement, Buyer is not reasonable satisfied in any respect <br /> with such data and information contained in the Environmental Study or receives notification <br /> from any reasonably reliable source that Hazardous Materials or underground storage tanks exist <br /> in; under or on the premises, then Buyer shall have the right to decline to purchase and acquire <br /> the premises, in its sole discretion, which right shall be in addition to any other right Buyer has <br /> under this contract. <br /> 11. The Buyer and Seller expressly acknowledge that this Purchase Contract was the <br /> result of willing, voluntary and good faith negotiations between Seller and Buyer, on behalf of <br /> each party, and further acknowledge that neither party acted in bad faith or in any manner <br /> attempted to compel or coerce the other, and accordingly each hereby releases the other from any <br /> and all costs, claims, demands, damages, rights of action or causes of action resulting from or <br /> arising out of any actions taken by the other party, including any officers or employees of either <br /> party, and including the Local Liquor Control Commissioner of the City of Decatur, relating to <br /> or concerning either City of Decatur Liquor License #951 A , including but not limited to the <br /> revocation or suspension of same, or the purchase of the premises by the City. This provision <br /> shall continue in effect after the execution and delivery of any deed for the premises to Buyer. <br /> 12.
