In conjunction with the execution of the AGREEMENT, ARCHITECT shall not <br /> discriminate against any employee or applicant for employment because of <br /> race, religion, color, sex, marital status, national origin or ancestry, age, <br /> physical or mental handicap unrelated to ability, or an unfavorable discharge <br /> from military service. ARCHITECT shall take affirmative actions to ensure <br /> that applicants are employed, and that employees are treated during their <br /> employment without regard to their race, religion, color, sex, marital status, <br /> national origin or ancestry, age, physical or mental handicap unrelated to <br /> ability, or an unfavorable discharge from military service. Such actions shall <br /> include, but not be limited to the following: (i) employment upgrading, <br /> demotion, or transfer; (ii) recruitment or recruitment advertising; (iii) layoff or <br /> termination; (iv) rates of pay, or other forms of compensation; and (v) <br /> selection for training including apprenticeship. <br /> Disadvanta_qed Business Enterprise Participation <br /> In conjunction with the performance of this AGREEMENT, ARCHITECT will cooperate with <br /> OWNER in meeting OWNER's commitments and goals with regard to the maximum utilization <br /> of disadvantaged businesses, and will use its best efforts to insure that disadvantaged <br /> businesses shall have the maximum practicable opportunity to compete for subcontract services <br /> under this AGREEMENT. It is understood the goal for participation in this PROJECT is <br /> 12.18% . <br /> Notices I <br /> The issuance of all written notices referenced in this AGREEMENT shall be by certified <br /> mail or similar verifiable delivery to the address designated by each party at the time of contract <br /> execution. A change in mailing address must be submitted in writing to the appropriate party. <br /> Severability <br /> It is understood and agreed by the parties hereto that if any part, term, condition, or <br /> provision of this AGREEMENT is held by a court of the United States to be illegal, the validity of <br /> the remaining provisions shall not be affected, and the rights and obligations of the parties shall <br /> be construed and enforced as if the AGREEMENT did not contain the particular part, term, <br /> condition, or provision held to be invalid. <br /> If it should appear that any provision hereof is in conflict with any statutory provision of <br /> the State of Illinois, said provision which may conflict therewith shall be deemed inoperative, <br /> null, and void insofar as it may be in conflict therewith, and each party shall be deemed properly <br /> notified to conform with such statutory provision. <br /> 12 of 16 <br />
