� • <br /> � ... <br /> , � , . <br /> AGREEMENT <br /> WHEREAS, the City of Decatur, Illinois ("City") and the County of Macon, Illinois <br /> ("County") did, on May 1, 1995, enter into an intergovernmental agreement ("master agreement") <br /> regarding the records and communications functions of the City and County, a copy of said <br /> master agreement being attached hereto as E�ibit A; and, <br /> Whereas, paragraph 4 of said master agreement attempted to allocate various costs <br /> between the parties, but in practice said paragraph has been difficult to administer and apply to all <br /> of the communications equipment and software operated by the City and County; and, <br /> Whereas, the City and the County agree that the responsibilities of each with regard to all <br /> of said equipment and software should be set out with greater specificity; and, <br /> Whereas, except as expressly stated herein, it is the intention of both the City and the <br /> County that said master agreement should continue in full force and effect. <br /> NOW, therefore, for and in consideration of the following provisions, the City and County <br /> agree as follows: <br /> l. That this agreement ("supplemental agreement") shall govern all matters regarding the <br /> allocation of costs between the City and the County for the communications function, as defined <br /> and described herein and in the master agreement, and in case of any conflict between the master <br /> agreement and the supplement agreement, the provisions of this supplemental agreement shall <br /> control. <br /> 2. The City shall be responsible for the maintenance and repair of the communication <br /> equipment located in the Emergency Communications Center("Center"), 333 S. Franklin, and <br /> certain other equipment and software. Since both parties agree that it is not possible to provide <br /> an itemized listing of every piece of equipment utilized in the communication function, it is agreed <br /> that the basis premise for deternuning maintenance shall be as follows: <br />
