Smith,Water Production Manager <br /> SUBJECT: License with Illinois Central Railroad <br /> Mile Post P 78.6 to Mile Post P 78.8 <br /> Security Fence Installation <br /> The closure plan approved by the Illinois Environmental Protection Agency for the City's South <br /> Water Treatment Plant sludge landfill site requires a security fence to be installed. The site is located <br /> immediately east of the Illinois Central Railroad (ICRR) right-of-way and to the west and north of the <br /> former Corley Western Wear building(refer to attached locale map). A portion of the fence will have to <br /> be installed in ICRR right-of-way. A license agreement has been prepared by the ICRR to allow the <br /> fence to be installed on its property. A copy of the agreement is attached. <br /> The agreement was prepared in 1997 by the ICRR at the request of Bainbridge, Gee & Milanski <br /> &Associates, Inc. (BGM) on behalf of the City. At that time, it was planned for the fence to be installed <br /> within the next year. In the process of completing the site survey BGM determined that the Corley <br /> building encroached onto the City's property. This encroachment has been a matter of discussion <br /> between City staff and the property owner. The discussions have met with delays because of conflicting <br /> staff priorities and because of pending sales and/or development interests in the Corley property. This <br /> matter is expected to be resolved in the next three months. Staff wants to proceed with obtaining the <br /> ICRR license as the railroad recently inquired about the project and the need far the City to execute the <br /> license agreement. <br /> It is recommended by staff that the City Council approve the attached resolution authorizing the <br /> Mayor to execute the agreement. <br /> City staff will be in attendance at the City Council meeting to answer questions about this matter. <br /> attach: 3 <br /> cc: Edwin V.
