/ , <br /> . , * , . <br /> , i , <br /> � 1 r + <br /> .� � ] <br /> � AGREEMENT <br /> WHEREAS, the Town of Long Creek("Town") owns and operates a water works system; and, <br /> WHEREAS, the City of Decatur, Illinois, ("City") owns and operates a water works system; and, <br /> WHEREAS, both parties desire to enter into an agreement to secure a supply of treated water <br /> from the system of the city for the system of the Town during episodes occasioned by a temporary failure <br /> of the Town's water works system or some part thereof. <br /> For and in consideration of the promises and covenants respectively to be performed by the <br /> parties hereto, it is agreed by and between the Town of Long Creek, and the City of Decatur, Illinois, as <br /> follows: <br /> 1. That the term of this agreement will be for a period of three (3) years commencing January 1, <br /> 1999. <br /> 2. (a) T'hat during the term of this Agreement, the Town may extend its water distribution <br /> system into the following areas: <br /> (i) That portion of Oakley Township lying east of the line described on Exhibit A <br /> hereto (the "boundary line"); <br /> (ii) That portion of Mt. Zion Township lying outside of the area bounded by said <br /> boundary line; and, <br /> (iii) That portion of Long Creek Township lying south and east of said boundary <br /> line. <br /> The Town may continue its water distribution system in that portion of South Wheatland Township lying <br /> in that area bounded by said boundary line. The Town may not expand service in any portions of the <br /> above described townships, other than in those areas expressly permitted herein, or any other township, <br /> without the prior, written approval of the City Manager, except as provided in subparagraph(b)hereof. <br /> (b) Within that area described on Exhibit B hereto, the following shall apply: <br /> 1 <br />
