R 98-134 � <br /> RESOLUTION AUTHORING AND APPROVING <br /> TRANSFER OF JURISDICTION OF <br /> � PORTION OF FORMER COUNTY HIGHWAY 31 <br /> WHEREAS, the County of Macon ("County") currently has jurisdiction and control over <br /> that portion of County Highway 31 commonly known as the South Shores frontage road <br /> ("highway"); and, <br /> WHEREAS, the County wishes to transfer jurisdiction thereof to the Decatur Park <br /> District ("District"); and, <br /> WHEREAS, the statutes of the State of Illinois require that the highway first be <br /> transferred to the City of Decatur("City"), then from the City to the District; and, <br /> WHEREAS, the City is willing to approve said transfer of jurisdiction, under certain <br /> conditions, and the District is willing to accept such conditions. <br /> NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section l. That the transfers of jurisdiction of the highway, as described in the <br /> agreements, copies of which are attached hereto as exhibits and are more fully described below, <br /> from the County to the City, and from the City to the District, be, and such transfers are hereby, <br /> authorized and approved. <br /> Section 2. That the Mayor be, and he is hereby, authorized and directed to sign the <br /> Jurisdictional Transfer Agreement attached hereto as Exhibit A, regarding transfer of jurisdiction <br /> of the highway from the Counry t� the City, anc� the Jurisdictional Transfer Aa eement attached <br /> hereto as Exhibit B, regarding transfer of the highway from the City to the District, and he is <br /> hereby further authorized and directed to sign any additional documents required to effect the <br /> jurisdictional transfers approved herein. _ <br /> PRESENTED and ADOPTED this 19th day of October, 1998. <br /> TE .
