tif.Dc9
C
u e
'/IIINOY
October 12, 1998
PUBLIC WORKS MEMORANDUM
NO. 98 - 70
MEMORANDUM TO: Honorable Mayor and City Council
FROM: James L. Williams, Jr., City Manager
Bruce A. McNabb, Director of Public Works
SUBJECT: Transfer of Highway Jurisdiction for Fisherman's Wharf Access Road
The Decatur Park District (DPD) would like to acquire jurisdiction for a section of County
Highway 31 (Southside Drive), commonly known as Fisherman's Wharf Access Road and as
shown on the attached maps, from Macon County. The purpose of this transfer of jurisdiction is
to facilitate a development project on adjacent property owned by the DPD.
Macon County is willing to make this transfer and attempted to do a direct transfer to the
DPD. Unfortunately, the State of Illinois says that a direct transfer from a County to a Park
District is not permitted due to State regulations. Therefore, the DPD and Macon County have
asked the City to facilitate this transfer by temporarily accepting this street from Macon County
and then transferring it to the Park District.
City staff has reviewed this request and has received assurance from representatives of the
Park District that it will accept the three stipulations that the City has requested to protect its
interests and those of adjacent property owners. The three stipulations are attached to the
transfer of jurisdiction from the City to the Park District. Copies of both of the transfer
agreements are attached.
Approval of the transfer agreements will not create any financial cost or obligation to the
City.
