(a) For the term of this agreement, until annexation, the Owner shall pay to the City annually <br /> an amount equal to that which the Owner would have paid to the County Collector in real property taaces <br /> levied by the City, including those taxes levied for the Decatur Public Library, if the Premises were <br /> located in the City. Such annual payments may be made in two (2) equal installments, due June 1 and <br /> September 1 of each year, but not less than one-half of the total due for any year shall be paid not later <br /> than June 1 of that year and the total amount for any year shall be paid not later than September 1 of that <br /> year. <br /> (b) If payments as required by subsection (a) hereof are delinquent, for the Premises or any <br /> portion thereof, the water service thereto may be shut off to the Premises, or such portion thereof to <br /> which the delinquent payments are allocable, until such time as said payment or payments are made, in <br /> the same manner as for delinquent payments of charges for water furnished. <br /> 8. The Owner shall be responsible for all improvements to any roads adjacent to the Premises as <br /> required by any governmental unit having jurisdiction thereof, including by and through plat or <br /> subdivision approval. <br /> 9. (a) Prior to annexation, the City shall provide police and fire protection to the Premises as if <br /> the same were located within the corporate limits of the City; provided that, nothing herein is to be <br /> construed as waiving any immunity to which the City would be entitled under the Local Governmental <br /> and Governmental Employees Tort Immunity Act (745 ILCS 10/1-101 et seq.), and nothing herein is to <br /> be construed as creating any special relationship between the parties or any special duty on the part of <br /> the City with respect to the Owner or its agents, employees, customers, invitees or lessees, or the agents, <br /> employees, customers or invitees of its lessees. <br />
