. � <br /> 4. Technical payroll cost is defined as salary cost plus (but not limited to) insurance, social <br /> security, vacation allowance and retirement costs. Direct expenses for items such as <br /> telephone tolls, stakes, iron pins, monuments, flagging, blue prints, copies, and computer <br /> shall be reimbursed at actual cost. Necessary vehicles shall be reimbursed at$0.31 per <br /> mile for miscellaneous mileage and at the rate of$38.00 per day for one half day or <br /> longer job assignments. <br /> Subject to the approval of THE CITY, THE ENGINEER may subcontract any necessary <br /> test boring or sub-surface exploration or aerial mapping services to be rendered in <br /> accordance with Section 1 of THE ENGINEER AGREES. THE CITY will pay the costs <br /> of such subcontracts to the ENGINEER plus 5 percent for administrative and o�ce <br /> handling. <br /> 5. That payment to the ENGINEER for services rendered under this AGREEMENT will be <br /> made monthly by partial payments based on costs to THE ENGINEER. <br /> IT IS MUTUALLY AGREED, <br /> 1. D" ute - That any differences between the ENGINEER and the CITY concerning the <br /> interpretation of the provisions of this AGREEMENT shall be referred to a committee of <br /> disinterested parties consisting of one member appointed by the ENGINEER, one <br /> member appointed by the CITY, and a third member appointed by the two above noted <br /> members, for disposition and that the committee's decision shall be final. <br /> 2. Com len tion- That all design services as stated in Pazagraph 1 of "THE ENGINEER <br /> AGREES" are to be completed under this AGREEMENT in accordance with the attached <br /> schedule within four(4) months after the CITY issues a written Notice to Proceed. All <br /> reimbursements provisions of this AGREEMENT are based on such completion. <br /> 3. Kev Personnel - That the CITY and the ENGINEER shall each designate, at the onset of <br /> the contract, a key contact person for this project. No changes in designated contact <br /> personnel will be made without the approval of both parties. <br /> 4. Successors and Assigns - That the CITY and the ENGINEER bind themselves, their <br /> successors, executors, administrators, and assigns to the other party of this <br /> AGREEMENT, and to the successors, administrators, and assigns of such other party in <br /> respect to all covenants of this AGREEMENT. <br /> d:\agree�DHA.wpd g <br />
