2. The vehicles used in the Program shall be wheelchair lift- equipped vans or ramp-equipped vans. 3. All CONTRACTOR'S drivers shall be properly licensed and shall meet all necessary state requirements. 4. CONTRACTOR will pick up the vehicle trip sheet for each day when they come to the DPTS storage facility to get the van. 5. The CITY shall, at CITY own expense, defend all suits that may be brought against Contractor on account of, or in connection with, or by reason of any damage or injury to life, limb or property, *connected with, growing out of or caused by any act or omission to act of CONTRACTOR or any employee of CONTRACTOR in or about the operation of said vehicle, *hereunder and shall save and keep harmless CONTRACTOR from any and all damages, judgments, costs and expenses of every kind that may arise or result by reason of the negligence of CONTRACTOR or the employees of CONTRACTOR by reason of, growing out of, or connected with the operation of said program and the carrying out of the terms and provisions of this Agreement. 6. The operators provided for the Program shall be employees of CONTRACTOR. CONTRACTOR shall certify to the CITY for each operator that: a. CONTRACTOR has workers compensation coverage for the operator; b. The operator has passed a physical examination as specified by the CITY; c. The operator has passed a drug test as specified by the CITY; d. The operator has the necessary valid operator's license; e. The operator has never had his or her operator's license suspended; f. The operator has never been convicted of, or pleaded guilty to, a felony charge; and g. CONTRACTOR has confirmed personal and professional references as given by the operator. * including any loss of passenger's personal property, however such loss may occur. ** or, the operation of the vehicle lift or ramp equipment, or, the transfer of the passengers to or from the vehicle or to or from their final destination. 3
