as follows: <br /> Section 1 All improvements encompassed by this agreement shall be made in <br /> accordance with all applicable State laws, rules, standards, regulations and orders and <br /> procedures in general. <br /> Section 2 The parties are of the opinion that the proper improvements in the <br /> interest of public safety at the aforesaid crossings should be: <br /> (a) the addition of a new sidelight on the southwest mast and the installation of constant <br /> waming time (CWT) circuitry to control the automatic flashing light signals (AFLS) in <br /> lieu of the existing AFO circuitry at the Imboden Road crossing. <br /> (b) the installation of CWT circuitry to control the AFLS in lieu of the existing audio <br /> frequency overlay (AFO) circuitry at the Franklin Street, Woodland Drive, Broadway <br /> Street, County Highway 31, County Highway 7 and County Highway 30 crossings. <br /> (c) the installation of CWT circuitry to control the AFLS in lieu of the existing GCP 600 <br /> circuitry at the Sand Creek Road crossing. <br /> Section 3 The Company has prepared preliminary estimates of cost to <br /> accomplish the proposed improvements which it may be required to perform, said estimates <br /> are attached as Exhibit B-1 through B-8, and shall upon order according to the <br /> requirements contained therein prepare detailed drawings, detailed circuit plans, estimates <br /> of cost and any required specifications for the proposed improvements for the approval of <br /> the Commission and Department. <br /> Section 4 The Company shall upon order, according to the requirements <br /> .contained therein, proceed toward the � completion of the proposed improvements, <br /> accomplishing the work with its own forces or appropriate contracted services and agrees <br /> that an appropriate time for the submission of plans should be ninety (90) days, for the <br /> submission of progress reports should be six (6) months and for the completion of the <br /> proposed improvements should be twelve (12) months, from the date of Commission order <br /> subsequent to this agreement. <br /> Section 5 The parties hereto agree that an equitable division of cost for the <br /> proposed improvements should be: <br /> (a) the cost to install the CWT circuitry at the Imboden Drive, Franklin Street, Sand <br /> Creek Road, Woodland Drive, Broadway Street, County Highway 31, Counry <br /> Highway 7 and County Highway 30 crossings and an additional sidelight at the <br /> Imboden Road crossing, estimated to be $235,570, should be divided 50% in an <br /> amount not to exceed $117,785 to the Grade Crossing Protection Fund ("Fund") <br /> with all remaining installation cost of the CWT circuitry being bome by the Company. <br /> 2 <br />
