Failure to provide satisfactory Certificates showing the required <br /> insurance or to keep the same in full force and effect shall be <br /> cause for the City to terminate any rights of DMHC under this Lease <br /> by verbal notice alone to DMHC or its agent . <br /> 10 . Maintenance. The City shall be responsible for all <br /> maintenance of the premises during the term of this Lease, and DMHC <br /> shall have no duty to repair or upkeep. <br /> � 11 . Enforcement. <br /> A. The City shall have no responsibility to enforce the - � <br /> exclusive use of any parking spaces reserved hereby to DMHC. It <br /> shall be the responsibility of DNIF-IC to own, install, operate and <br /> maintain any system or procedure whether mechanical or otherwise <br /> winicii is intended to secure the use of the spaces described herein <br /> for the exclusive use of DMHC. Any sucn system or procedure prior <br /> to initiation or installation shall be approved by the Director of <br /> Public Works of the City. <br /> B. The City shall r.ot be responsible for the <br /> maintenance for any fixture or other improvement placed by DMHC <br /> pursuant to subsection A hereof . With regard to such fixtures or <br /> installations DMHC does hereby release, discharge, indemnify and � <br /> hold harmless the City and City Council Members, City employees, <br /> officers and agents in both individual and official capacities from <br /> any and all claims, demands, damages, rights of action, or causes <br /> of action for personal or bodily injury, death or property damage <br /> relating to or arising out of the operation and use of such <br /> fixtures and installations.
