RESOLUTION NO. R97-49 <br /> RESOLUTION REQUESTING TEMPORARY CLOSING <br /> OF A PORTION OF LAKE SHORE DRIVE <br /> - MEMORIAL DAY WEEKEND - <br /> WHEREAS, SummerStart, Inc. is sponsoring a festival in the City of Decatur, which <br /> event constitutes a public purpose; and, <br /> WHEREAS, this festival will require the temporary closure of Lake Shore Drive, a State <br /> Highway in the City of Decatur, from South 16th Street to East Cantrell Street; and, <br /> WHEREAS, Section 4-408 of the Illinois Highway Code, (605 ILCS 5/1-101 et seq.), <br /> authorizes the State of Illinois Department of Transportation to issue permits to local authorities <br /> to temporarily close portions of State Highways for such public purposes. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That permission to close off Lake Shore Drive from South 16th Street to East <br /> Cantrell Street, as above designated, be requested of the Department of Transportation. <br /> Section 2. That this closing shall occur during the approximate time period between <br /> 12:00 P.M. (Noon) on Friday, May 23,through 6:00 A.M. on Tuesday, May 27, 1997. <br /> Section 3. That this closure is for the public purpose of a community festival. <br /> Section 4. That traffic from the closed portion of highway shall be detoured over routes <br /> with an all weather surface that can accept that anticipated traffic, which will be rriaintained to <br /> the satisfaction of the Department and which is conspicuously marked for the benefit of traffic <br /> diverted from the State Highway. <br /> Section 5. That the City of Decatur assumes full responsibility for the direction, <br /> protection and regulation of the traffic during the time the detour is in effect. <br /> Section 6. That all debris shall be removed by the City of Decatur prior to reopening the <br /> State Highway. <br /> Section 7. That the closure and detour shall be marked according to the Illinois Manual <br /> on Uniform Traffic Control Devices. <br /> Section 8. That the City of Decatur hereby agrees to assume all liabilities and pay all <br /> claims for any damage which shall be occasioned by the closing described above. <br /> Section 9.
