Decatur Angler's Association <br /> and <br />' City of Decatur <br /> �sh Rearing Pond Agreement <br /> The purpose of this agreement is to grant permission to the Decatur Angler's Association <br /> (DAA) to operate a fish rearing pond (Pond) on City of Decatur (City) property located on <br /> N. Country Club Road, in Decatur, commonly referred to as the 1988 sediment storage site � <br /> (Site). The City's tree debris burn area on the east side of the Site is excluded from this <br /> agreement. <br /> The terms of this agreement are as follows: <br /> The City shall: <br /> 1. Allow the DAA to operate the Pond under the terms of this agreement until <br /> December 31, 2002, provided that DAA or City may terminate this agreement at any <br /> time within 60 days with prior written notice. <br /> The DAA shall: <br /> 1. Use only the Pond, drive and parking areas of the Site. . <br /> 2. Use the Pond only for not-for-profit fish rearing activities. <br /> 3. Provide the City with an annual report of DAA Pond activities, submitted no later <br /> than December 31st of each year. <br /> 4. Indemnify and save harmless the City, its agents and employees, from and against any <br /> and all claims, suits, losses, damages, costs and expenses in any manner resulting from <br /> or arising out of, but not limited to, the activities associated with this agreement. <br /> 5. Upon agreement approval, the DAA shall provide the City's Risk Manager with proof <br /> of commercial liability insurance coverage, with the City named as an additional <br /> insured, for only the Pond, drive and parking areas of the Site, prior to the start of any <br /> Site development. The minimum coverage limits shall be: <br /> General Aggregate $1,000,000 <br /> Products - Comp/Op Agg. $1,000,000 <br /> Personal & Adv. Injury $1,000,000 <br /> Each Occurrence $1,000,000 <br /> Fire Damage (any one fire) $ 50,000 <br /> Medical Expenses (any one person) $ 5,000 <br />
