� • . . <br /> � ' BOOK 2� �.C� PAGE s � <br /> (2) During thc period of construction, the City shall have the right of use of the temporary <br /> easement, said temporary easement to be indicated on said Plat and made a part hereof. <br /> (3) The City shall have the right and obligation to restore the surface of that part of the <br /> property herein described used for construction purposes, to as near as practical to its original grade and <br /> sced any disturbed areas which were used as lawns,pastures and greenways at the time of this easement. <br /> (4) Any fence or other improvement not inconsistent with this easement which was located on <br /> the area covered by this eascment,but which is moved or disturbed during construction, shall be restored as <br /> nearly as possible to its condition immediately prior to construction,at the expense of the City. <br /> (5) The City shall makc reasonable effort to preserve any trees, shrubbery, or other items of <br /> landscaping during construction, but the City shall have the right to remove, without obligation to replace, <br /> trees and shrubbery within the arca covered by the permanent and temporary easements where such <br /> removal is reasonabl}� nccessary• to thc economical construction, reconstruction, or repair of the sewer and <br /> for the acccss of equipmcnt, but will pay for reasonable damages to lawn, ornamental shrubs and trees. <br /> (6) Said public utilitics and all facilities used or useful in connection therewith sha11 be <br /> installed and maintained at City's sole risk and expense, with due diligence and in a workmanlike manner, <br /> and City shall indemnify and save Grantor(s) harmless from any loss, damage, or injury to person or <br /> property arising out of the City's operations hereunder, except such as may directly result from the _ <br /> negligence of Grantor(s). <br /> (7) The Grantor(s)or his,her,their, or its successors in title shall have the right to connect to <br /> public utilities with thc prior written conscnt of the City, which shall not be unreasonably w�ithheld, at no <br /> cost to Grantor. <br /> (8) This Agrecmcnt contains all the terms and conditions agreed upon by the parties and no <br /> other agrecmcnts, oral or othcrwisc,shall be deemed to exist. <br />' Thc Grantor(s) hcrcb�� rcicasc(s) and waiv�r(s) all rights under any by virtue of the Homestead <br />' Excmption Laws of thc State of Illinois. <br />
