� .. <br /> (1) To make leases with tenants for a term of one crop year; with the privilege of renewing <br /> said lease from year to year if tenant proves satisfactory. <br /> (m) To perform all acts in connection with any agricultural programs under the jurisdiction <br /> of the United States Department of Agriculture and administered by the respective ASCS <br /> County Committee in which the above described farm real estate is located. <br /> 3. Magna Trust Company shall: <br /> (a) Use its best efforts by approved modern, scientific and pra�cdcal farming methods to <br /> achieve the objectives as set forth by the Owner. <br /> (b) Furnish all necessary plans and instructions to properly operate the farm real estate. <br /> (c) Direct the farming operations which shall include the selection of seed, fertilizers, <br /> herbicides, insecticides; the storage and drying of grain; the type of tillage operation , <br /> performed; the rotation, planting, and harvesting of all crops; and the making of I <br /> general repairs and other necessary improvements. <br /> (d) Have periodic soil tests and analysis made with owner's prior approval at the Owner's <br /> expense and treat the land to develop an appropriate state of fertilization according to � <br /> the Owner's desires. <br /> (e) Make periodic visits to the farm real estate for the purpose of supervising the farming <br /> operation and shall report such information to the Owner on at least a bi-monthly basis. <br /> (� Participate in the NSAFE" nutrient management services program developed by Maran <br /> Associates and the Conservation Technology Information Center's "Farming for <br /> M�imum Efficiency" program. <br /> (g) Supervision of the maintenance (by mowing, herbicide application, or other suggested <br /> methods) of existing and future grass waterways and filter strips (including labor, <br /> supplies and equipment). <br /> 4. Magna T�vst Company shall furnish to the Owner cunent financial reports showing receipts <br /> and disbursements from the above account for the periods ending the last day of March, June, <br /> September, and December of each calendar year. A complete detailed report of the <br /> preceding calendar year's account shall be furnished within 30 days or as soon thereafter as <br /> possible. The state of the Owner's account shall be furnished at any time upon request by <br /> the Owner. <br /> 5. The Owner shall pay Magna Trust Company a $1,500.00 annual flat fee as compensation <br /> for its services. This compensation shall be calculated and collected at the end of March, <br /> 7une, September, and December of each calendar year. <br /> 6. The supervision of capital improvements and major regair projects shall be deemed as outside <br /> this contract. Supervision of improvements will be provided by Magna Trust Company at <br /> the request of the landowner. Fees will be charged on an hourly basis plus expenses for the <br /> actual time involved. <br />
