NDC shall comply �vith requirements for the provisions of the liniform Relocation <br /> assistance and Real Property Acquisitions �ct of 1970 (P.L. 91-6=�6) which provides <br /> for fair and equitable treatment of persons displaced as a resiilt of Federal and <br /> federall�� assisted pro�rams <br /> B. �DC shali comply �vith the provisions of the Hatch Act �vhich limit the political <br /> activitv of employees. <br /> C. NDC shall establish safeguards to prohibit employees from usin� their positions for <br /> purpose that is or gives the appearance of being motivated by a desire for private�ain <br /> for themselves or others, particularly those��ith whom they have family, business and <br /> other ties. <br /> D. NDC shall insure that the facilities under its ownership, lease or supervision, which <br /> shall be utilized in the accomplishment of the instrument, are not listed on the <br /> Environmental Protection Agency (EPA) list of violatin� facilities and that it shall <br /> notify HUD of the receipt of any communication from the Director of the EPA, <br /> Office of Federal Activities, indicatin�that a facility to be used in the project is under <br /> consideration for listin� by the EPA. <br /> E. NDC shall assist HUD in its compliance �vith Section 106 of the National Historic <br /> Preservation Act of 1966 as amended (16 U.S.C. 470), Executi��e Order 11593, and <br /> the Archeological and Historic Preservation Act of 1966 (16 U.S.C. 469a-1 et. seq.) <br /> by (a) consulting with the State Historic Preservation Officer on the conduct of <br /> investijations, as necessar_y, to identify properties listed in or eligible of inclusion in <br /> the National Register of Historic Places that are subject to adverse effects (see 36 <br /> CFR, Part 800.8) by the activity, and notify the Federal brantor agency of the <br /> esistence of any such properties, and b�� (b) complying with all requirements <br /> established by HUD to avoid or mitigate adverse effects upon such properties. <br /> F. NDC shall comply with Section 504 of the Rehabilitation Act of 1973, as amended <br /> (29 U.S.C. 794, P.L. 93-112), and all requirements imposed by or pursuant to the <br /> reaulation of the Department of Health and Human Services (45 CFR, Parts 80, 81 <br /> and 84), promulgated under the foregoing statue. It agrees that, in accordance with <br /> the foregoing requirements, no otherwise qualified handicapped person, by reason of <br /> handicap, shall be excluded from participation in, be denied the benefits of or be <br /> subjected to discrimination under any program or activity receivin� Federal financial <br /> assistance, and that it shall take any measures necessary to effuctuate this Agreement. <br /> G. NDC shall comply, to the extent applicable, with Title IX of the Education <br /> Amendments of 1972, 20 U.S.C. 1981, et. seq., which provides that no person in the <br /> United States shall, on the basis of sex, be eYcluded from participation in, be denied <br /> the benefits of, or be subjected to discrimination under any educational program or <br /> 10 <br />
