NDC agrees to submit to the Comptroller of the City of Decatur one copy of its annual audit. �pplicability of the Singie Audit Act T'his A�reernent is subject to the requirements of the Sinale Audit Act of 1984 (31 USC 7�01-7�07) and HUD's implementation of the Single Audit Act as published in Chapter 24 of the Code of Federal Re�ulations, Part 44. V. TERtiIS :�r'D CONDITIONS O�vnership of Nlaterial 1nd Documents NDC shall ensure reco�nition of the role of the CITY in providina the services funded throu�h this Agreement by means that include but are not limited to the followin�: NDC ayTrees that all printed material associated with the services provided through this Agreement shall include the phrase, "The City of Decatur is a partner in this proaram." Additionally, publicity reQarding this program shall acknowled�e the role of the CITY in funding the services. All reports and training materials and other materials prepared by NDC shall be the property of the CITY. NDC shall deliver such materials to the CITY in accordance with the terms and conditions of this Agreement. The CITY shall not, without NDC written consent, associate NDC's name with the product, if a subsequent chan�e is made in NDC's work product after submission. Release of Information No ne�vs releases, including photographs, public announcements or confirmation of same, or any part of the subject matter of the Agreement or any phase of any proaram hereunder shall be made without prior written approval of the CITY. Confidentiality of Reports NDC shall keep confidential all reports, information and data given to, prepared or assembled by NDC pursuant to NDC's performance hereunder and CITY designates as confidential. Such information shall not be made available to any person, firm, corporation or entity without the prior written consent of the CITY first obtained. 4
