AMENDMENT NO. 2 TO A STATE/FEDERAL CAPITAL GRANT AGREEMENT BETWEEN THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION DIVISION OF PUBLIC TRANSPORTATION AND THE CITY OF DECATUR CONTRACT NUMBER: 1807 STATE GRANT NUMBER: CAP-92-404-FED FEDERAL GRANT NUMBER: IL-03-0160 This Amendment No. 2 to an Agreement, as amended, dated February 27, 1992, between the State of Illinois, Department of Transportation, Division of Public Transportation and the CitX of Decatur, is made and entered into by and between the parties thereto. In consideration of the mutual covenants contained herein and in such Agreement, the Parties agree as follows: 1. To amend Part I of the "Mass Transportation Capital Grant Agreement" by deleting paragraph 1 of ITEM 2 and replacing it with the following: ITEM 2 - AMOUNT OF GRANT The Department agrees to make a Grant in an amount equal to $1.794,124.46, or 100 percent of the actual total project cost, whichever is less. The actual project cost shall be determined by the Department after completion of the project. No liability shall be incurred by the State in excess of the amount of the Grant. The Approved Project Budget is shown in Exhibit B, attached to and incorporated into this Agreement. 2. To amend Part I of the "Mass Transportation Capital Grant Agreement" by deleting paragraph 1 of ITEM 4 and replacing it with the following: ITEM 4 - ILLINOIS GRANT FUNDS RECOVERY ACT This Grant is subject to the Illinois Grant Funds Recovery Act, Public Act No. 83-640. This Grant is valid until January 1. 1997, and grant funds are available to Grantee and may be expended by Grantee until said date unless the Department, at its discretion, grants an extension of time. Any grant funds which are not expended or legally obligated by the Grantee at the end of the grant agreement or by the expiration of the period of time grant funds are available for expenditure or obligation, whichever is earlier, shall be returned to the Department within 45 days. Project closeout shall be in accordance with Item 110 of this Agreement.
