. •. <br /> WATER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants set out herein, it is agreed by <br /> and between the Owner(s) of the premises described at paragraph 8 hereof, and which person or <br /> persons are signatory hereto, ("Owner"), and THE CITY OF DECATUR, ILLINOIS, ("City"), as <br /> follows: <br /> 1. The provisions of this Agreement, and the installation, operation and use of the water <br /> service authorized hereby, are expressly made subject to all applicable provisions of codes, <br /> ordinances, rules and regulations of City, and the provisions of this Agreement, and Owner <br /> agrees to comply therewith. <br /> 2. After completion of the construciion or a water main by tne City in the street or <br /> roadway adjacent to the premises described herein, and upon obtaining a tapping permit in the <br /> customary manner followed by the City for premises within its corporate limits, Owner may tap <br /> said water main of City and connect a water service thereto to furnish service only to the church <br /> and other buildings associated therewith located on said premises. <br /> 3. Said tap, connection and service shall be made and installed by a licensed plumber. <br /> 4. The water furnished by City shall only be used for purposes, and only upon the <br /> premises, described herein. <br /> 5. The owner of the premises described herein shall annex the same to the City prior to <br /> the approval by the City of any subdivision plat for said premises. <br /> 6. This Agreement shall terminate upon the failure by Owner to comply with any <br /> provisions hereof or with any applicable provision of City Code, ordinances, rules or regulations, <br /> or upon the annexation of said premises to the City, and may be terminated by either party upon <br /> six (6) months notice by certified mail to the City or to East Park Baptist Church, 1909 <br /> Baltimore, Decatur; IL 62521 if to the Ovvrzer. <br /> 7. This Agreement is intended for the benefit of said premises as well as the current <br /> owner and occupant thereof and to said end shall be binding upon and inure to the benefits of <br /> said owner and its successors in title. <br /> 8. The premises referred to herein, and to which the terms, conditions and provisions of <br /> this Agreement apply, axe legally described as follows: <br /> The Northwest 1/4 of the Northwest 1/4 of Section 29.
