Lessor's obligations under this Lease. Lessee further agrees that Lessor shall not be liable for any damages resulting to Lessee from such action whether caused by negligence of Lessor or otherwise. Acceptance of possession of the demised premises by Lessor from Lessee shail not constitute an acceptance of a surrender of the d�mised premises as such unless Lessor shall specifically acknowledge the same in writing. Except as otherwise provided by statute or rule of law, pursuit of any of the foregoing remedies shall nat preclude pursuit of any of the other remedies provided for herein or any other remedies provided by law, all of which may be enforcetl cumulatively, nor sha11 pursuit of any remedy provided for herein constitute a forfeiture or waiv$r of any rent due to Lessor hereunder or of any damages accruing to Lessor by reason of the violation of any of the terrns, provisions and covenants herein contained. Faiiure hy Lessor to enforce one or more of the remedies herein provided upon an event of default shall not deemed or construed tv constitute a waiver of such default, or of any other violations or breach of any of the terms,provisions and covenants herein contained. 15. Lessee hereby agrees to purchase the leased premises from the Lessor for the sum of $75,400. The closing of the purchase shall be held within 30 days after the end of the lease term, and the closing costs and pro rationing of related expenses on the property shall be made according to the usua.l and customary practice in Macon County, Illinois. Lessee waives the right to house those individuals who are residing in the facility at the end of the lease, if lessee defaults on purchasing the facility. Lessee hereby aclrnowledges that the individuals residing in the facility stay with the building, as it is their "home". Lessee agrees not to solicit any of the then-current residents of the leased premises if Lessee fails to purchase the premises as required herein. 16. All notices, demands, requests, consents, approvals and other instruments required or � permitted to be given pursuant to the terms hereof shall be in writing and shall be deemed to have been properly given if sent by registered or certified mail, postage prepaid, or telegram, charges prepaid,addressed ta the parties herein at the addresses shown on the first page thereof. 17. All of the covenants, conditions and obligations herein contained sha11 be binding upon and inure to the benefit of the respective successors and assigns of the parties hereto to the same extent as in each successor and assign were in each case named as a party to this Lease. 7
