.8 Preparation for,and attendance at a dispute resolution proceedin�or legal proceedin�.except�vhere the Architect is party thereto; .9 Evaluation of the qualificatioos of bidders or persons providing proposals; .10 Consultation conceming replacement of Work resulting from fire or othcr cause during coristruction; or .11 Assistance to the tnitial Decision Mal:er,if other than the Architect. § 4.3.2 To avoid delay in the Construction Phase,the Architect shall provide the following Additional Services, notify the O�mer with reasonable promptness,and explain the facts and circumstances siving rise to the need. If the Owner subsequently determines that all or parts of those services are not required,the Owner shall give prompt written notice to ti�e Architect,and the Owner shall have no further obligation to compensate tf�e Architect for those services: .1 Reviewing a Contractor's submittal out of sequence from the submittal schedule agreed to by the Architect(a deductive change order to the Contractor's contract sum will be processed periodically for the cost of such services incurred hy the Owner); .2 Rcsponding to the Contractor's requests for information that are not prepared in eccordance with the Contrect Documents or where such information is avnilable to the Contractor from a careful study and compatison of the Contract Documents,field conditians,other Owner-provided information, Contractor-prepnred coordination drawings,or prior Project correspondence or documentation{a deductive change order to the Cootractor's contract sum will be processed periodicafly for the cost of such srn+ices incurred by the Owner); .3 Preparing Chan�e Orders and Construction Change Directives that require evaSuation of Contractor's proposals and supponing data,ar the preparation or revision of Instruments of Service{a deductive chan�e order to the Contractor's contract sum will be processed periodically for the cost of such services incucred by the Owner); .4 Eva�uating an extensive number of Claims as the Initial Decision Maker; .5 Evafuatin�substitutions praposed by the Owner or Contractor and making subsequent revisions to [nstruments of Service resulting there&om(a deductive change order to the Contractor's contract sum will be processed periodical[y for the cost of such services incurred by the Owner);or .6 Providing Construction Phase Services 60 days after(1)the date of Substantial Completio�of the Work or(2)the anticipated date of Substantial Completion identified in[nitial Information, whichever is earliec{a deductive chan�e order to the Contractor's contract sum will be processed periodically for the cost of such services incurred by the Owner}. § 4.3.3 The McF�itect sl�atl provide Construction Phase Services exceedin�the limits set forth below far each station building as Additional Services. When the limits below are reached,the Architect shall notify the Owner. .1 two (2)reviews of each Shop Drawing,Product Data item,sample and similar submittal ofihe Contractor(a deductive change order to the Contractor's contract sum will be processed periodicaily for ihe cost of such services incu�red by the Owner) .2 eight{8)visits to the site by the Architeci over the duration of the Project duric►g consiruction .3 one 1 )visits for any portion of the Work to de�ermine whether such portion of the Work is substantially complete in accordance with the requirements of'the Contract Documents(a deductive change order to ihe Contrector's contract sum will be processed periodically for the cost oFsuch services incurred by the Owner) .4 one I )visits for any portion of the Work to determine final completion(a deductive change order to the Contractor's contract sum will be processed periodically for the cost of such services incurred by the Owner) § 4.3.4 If the services covered by this Agreement have nol been completed within Eig}tteen (18)months of the date of this Agreement,through no fault of the Architect,extension of the Architect's services beyond that time shaU be compensated as Additional Services. ARTICLE 5 OWNER'S RESPONSIBIUTIES § 5.1 Unless otherwise provided for under this Ageement,the Owner shall provide information in a timely manner regerding requirements for and limitations on the Project,including e written program which shall set forth the Owner's objectives,schedule,constraints and cri�eria,including space requirements and relationships,flexibility, expandability,special equipment,systems and site requirements.
